BRAZILIAN PRESIDENT, MICHEL TEMER, ENACTS LAW THAT PROVIDES PROTECTION TO CONSUMERS OF PUBLIC SERVICES RENDERED BY THE PUBLIC GOVERNMENT

Law n. 13.460, of June 26th 2017, sets forth basic rules for participation, protection and defense of the rights of the users of public services rendered direct or indirectly by the Public Government. The public services Concessionaires are also subject to this new rule. more


CORPORATE LAW:
BRAZILIAN SECURITIES COMMISSION (CVM) REGULATES CROWDFUNDING

CVM enacted in 13th July 2017 Regulation 588, which regulates the public offering of securities issued by small companies through electronic platform - Crowdfunding. more

LISTED COMPANIES APPROVE NEW REGULATION FOR NOVO MERCADO IN BRAZILIAN STOCK EXCHANGE

In June 2017 Brazilian Stock Exchange – B3 announced the approval of the new regulation of the corporate governance segment called Novo Mercado. The changes were being discussed with the 131 listed companies in this segment and with market players since March, 2016. more


ANTITRUST LAW:
BRAZILIAN ANTITRUST AUTHORITY (CADE) AND BRAZILIAN CENTRAL BANK (BACEN) TO FORM A WORKING GROUP TO DISCUSS ANTITRUST IN THE NATIONAL FINANCIAL SYSTEM

CADE and BACEN formed a Working Group to study and discuss antitrust matters related to the National Financial System, focusing in form, limits of competence and cooperation among them. The Working Group is formed by 4 representatives of each authority and will have 120 days to conclude their activities, with the possibility of extending this period, if necessary. more


ARBITRATION LAW:
BASED ON VIOLATION OF PUBLIC POLICY, BRAZILIAN SUPERIOR COURT DENIES RECOGNITION AND ENFORCEMENT OF ARBITRAL AWARD

On 19th of April 2017, Justices of the Brazilian Superior Court denied recognition and enforcement of a U.S. arbitral award which determined the Brazilian company Adriano Ometto Agrícola to indemnify in more than U$100 mi the Spanish company Abengoa Bioenergia. more

INTELLECTUAL PROPERTY:
THE BRAZILIAN COMPANY COPAG IS PLAYING HARD AGAINST COUNTERFEIT PRODUCTS

Recently, on behalf of the Intellectual Property department of the Siqueira Castro Advogados Office, COPAG filed a lawsuit against AIH. This company tried to import from China 96,000 (ninety six thousand) games that bear, on back of each card, a figurative trademark that is owned by COPAG. more


REGULATORY LAW:
BRAZILIAN GOVERNMENT ANNOUNCED NEW PROJECTS REGARDING CONCESSIONS

As part of the Partnership Investment Program (PPI) Brazilian Government announced new projects regarding concessions aiming to improve the provision of public services and stimulate employment opportunities. more


LABOR LAW:
BRAZILIAN CONGRESS APPROVES LABOUR REFORM LAW

In the last month of July, after a brief processing in Brazilian Congress, the reform to the Brazilian Labor legislation was approved, pursuant Law n. 13.467/2017. More than 100 sections of the current Labor Law (“CLT”) were amended. more

JBS CONTROLLING SHAREHOLDERS ARE BEING INVESTIGATED FOR INSIDER TRADING WITH BASIS ON MARKET MOVES BEFORE CELEBRATING A PLEA DEAL

Recently, the controlling shareholders of JBS company celebrated a collaboration agreement with the Public Prosecution Office through which evidence of practices of corruption involving important governors, including the current President of Brazil, were disclosed to the prosecutorial authorities. more
